The lawsuit centers on allegations that the Facebook Messenger and Messenger Kids applications improperly collected and retained biometric identifiers, a matter of significant concern under the Illinois Biometric Information Privacy Act (BIPA).
In a recent order issued by Judge Nancy J. Rosenstengel of the US District Court for the Southern District of Illinois, it was determined that the plaintiffs have sufficiently articulated their claims. They assert that Meta’s applications engaged in practices that involved scanning users’ facial geometries—scans that can potentially identify individuals based on their unique facial features.
Despite Meta's arguments to the contrary, the court found that the allegations warranted further examination. The company contended that the facial scans in question do not fall under the purview of BIPA, but the judge's ruling indicates that the legal scrutiny will continue.
