Windows 10 Phase-Out Sparks Legal Action Against Microsoft

In a recent development in the tech world, San Diego resident Lawrence Klein has initiated a lawsuit against Microsoft following its decision to conclude Windows 10 support by October 2025. Klein contends that this move forces users to buy new devices and paves the way for Microsoft to consolidate its presence in the burgeoning generative AI industry.

Klein's Allegations Against Microsoft

According to Klein's complaint, Microsoft, leveraging its dominant position in the operating systems market, is pushing users towards the adoption of Windows 11 and Copilot+ PCs. This, he claims, leads to unnecessary purchases of new hardware, placing consumers—including businesses handling sensitive data—at financial risk. The complaint highlights the looming cybersecurity threats millions will face if unable to upgrade before support ceases.

Data from April 2025 shows that approximately 52.94% of all Windows users were still operating on Windows 10. Klein estimates that around 240 million devices could become obsolete this October due to insufficient hardware to run Windows 11, contributing significantly to e-waste. He suggests this environmental issue is avoidable if Microsoft continues support for Windows 10.

Concern Over Transition Timeline

Klein also points out a departure from Microsoft's historical approach to operating system transitions, which traditionally allowed 7–8 years for users to adapt. The swifter transition to Windows 11, just four years after its release, adds further pressure. He argues that Windows 11's features do not justify a forced migration and remains unpopular among users.

Demands for Greater Transparency and Extended Support

In his legal filing, Klein seeks judicial intervention to halt misleading advertisements about Windows 10 and calls for clear disclosure of the end-of-support ramifications and available security alternatives. Furthermore, he requests the court compel Microsoft to continue providing free updates until Windows 10 usage drops below 10% of all Windows users.

Although Klein is only seeking attorney's fees, the intricacies involved suggest a resolution is unlikely before the official end of support date, set for October 14, 2025.
